§ 1. DEFINITIONS

1. „Organizer” - NUMIS POLAND Krzysztof Klitończyk with registered office at Kazimierza Odnowiciela 1, 62-050 Mosina k. Poznania, Tax ID: 7651171479, which issues items for auctions via the Onebid.pl portal.
2. “Auction” – the auction is conducted via the Onebid.pl portal with an Internet address https://onebid.pl/.
3. “Participant” – an entity participating in the Organizer's Auction on the Onebid.pl portal. 
4. “Auction winner” – The participant whose offer was the highest, which was confirmed and who won the auction. 
5. „Agreement” – a sales agreement concluded with the Auction Winner in the cases described in detail below.
6. „Auction fee” – this is an additional fee not included in the currently presented offer. It is additionally added to the amount that the winner of the auction has to pay. Its height has been determined below. 

§ 2. PARTICIPANT’S CONSENTS

1. The Participant, by taking part in the Auction, accepts and agrees to the content of these regulations.
2. The Participant expresses voluntary consent for the Organizer to process his personal data for purposes related to the Auction and the conclusion and finalization of the Agreement.
3. The participant also declares that he has read the Regulations of the Onebid.pl portal and fully accepts it.

§ 3. AUCTION

1. The auction takes place only on the Onebid.pl portal. The time of the auction, its detailed terms and its subject are each time specified on the website of the item on the Onebid.pl portal. In the absence of any other objections, the following auction rules apply.
2. The Auction Participant may only be an adult and having full legal capacity under Civil Law, legal persons and organizational units that are not legal entities to which the law gives legal capacity.
3. The Auction starts only with the moment specified on the website of the given item from the starting price.
4. The object may have a specific minimum offer below which the conclusion of the Agreement requires the consent of the owner.
5. All offers submitted before the start of the auction in any form are invalid.
6. Binding and valid are only offers submitted during the Auction via the Onebid.pl portal.
7. An offer submitted in the course of the Auction ceases to be binding when another Participant of the Auction has submitted a more advantageous offer.
8. The end of the Auction takes place with the moment of the best offer being confirmed.
9. If the highest offer is below the minimum offer, no sales agreement is concluded until the owner of the object has given permission.
10. If the highest offer is higher than or equal to the minimum offer, the sales agreement is concluded at the moment of the purchase.
11. The Organizer may demand cancellation of the concluded Agreement if the party to the Agreement, another Participant or a person acting in agreement with them influenced the result of the Auction in a manner contrary to the law or good practices.

§ 4. PAYMENT OF PRICE

1. The sales price of the auctioned items is a confirmed offer increased by an auction fee of 18% of the auctioned amount.
2. The auctioned price is subject to payment within 10 calendar days from the end of the Auction.
3. Failure to pay the price on the date indicated entitles the Organizer to set an additional deadline for payment, under pain of withdrawal from the Agremeent.
4. In the event that the above deadline expires unsuccessfully, the Organizer will be entitled to withdraw from the Agreement and may demand compensation for any damage resulting from the delay. 
5. Notwithstanding the above rights, the Organizer has the right to charge statutory interest for delay if he does not effectively exercise his right to withdraw from the Agreement.
6. The right of ownership of the object of the Auction shall pass to the winner of the Auction only when the whole price has been paid.
7. The price may be paid to the Organizer's bank account: Mbank:

8. The price may also be paid in cash at the Organizer's office if the amount of the entire transaction, regardless of the number of payments resulting from it, does not exceed EUR 15,000, whereas transactions in foreign currencies are converted into PLN at the average foreign exchange rate announced by the National Bank of Poland on the last business day preceding the transaction date.

§ 5. ISSUE OF OBJECTS

1. The items being the object of the Auction shall be issued only after the Winner has paid the entire price, i.e. only after the ownership has passed.
2. Items can be picked up in person by the Auction Winner at the Organizer's office.
3. It is also possible to send the auctioned items in a form agreed individually between the Organizer and the Auction Winner.
4. All costs of issuance or sending the auctioned items shall be fully charged to the Auction Winner.
5. The items shall be sent after arranging the shipping method, paying the costs related to the Auction by the Winner and after paying the total price.
6. Any additional fees related to the dispatch of items of the auction shall also be charged to the Auction Winner, in particular the insurance of the shipment in question. 
7. The time of shipment of items is up to 7 business days from the moment the transfer is credited to your bank account.
8. The cost of foreign shipping, up to the purchase amount of PLN 1,000, Polish Post - PLN 25, above the amount of PLN 1,000, only courier costs PLN 100.
   
   

§ 6. CLAUSES AND ADDITIONAL RESERVATIONS

1. Items entered into the Register of Monuments or worth over PLN 16,000 may be exported outside of Poland only after obtaining an export license. The Organizer instructs the Participants that the free disposal of the auctioned items may be subject to restrictions resulting from the Act of 23 July 2003 on the protection of monuments and care over monuments, in particular from Article 51 of the above Act, which provides, inter alia the need to obtain permission to export certain monuments outside of Poland. 
2. The Organizer does not take any responsibility for the above restrictions and does not declare any intermediation or assistance in the activities resulting from the above Act and aggravating the owner.
3. The Participant's personal data is collected only for the purpose of conducting the Auction and the conclusion and implementation of any Agreement concluded.
4. Access to the Participant's personal data is only provided by the Organizer and they are not made available to third parties, with the exception of the one necessary to implement the subject of the Agreement, in particular, to send the Auction items to the Auction Winner.
5. The Participant has the right to access their data and correct them.
6. Personal data, if not submitted directly by the Participant himself, come from the Onebid.pl portal.
7. The Organizer is not responsible for technical problems related to the functioning of the Onebid.pl portal.

§ 7. FINAL PROVISIONS

1. The Organizer reserves the right to change these regulations, with the reservation that changes in the regulations come into force within 7 days of their announcement on the Onebid.pl portal.
2. If any provisions of the regulations are invalid for any reason, the remaining provisions shall remain in force.
3. The applicable law for relations between Participants and the Organizer is generally applicable Polish law, in particular the provisions of the Civil Code. 
4. The Organizer informs that in the case where the buyer is a consumer under the provisions of the Civil Code, he is entitled to the warranty for defects in the sale.
5. If the buyer is an entrepreneur in accordance with the provisions of the Civil Code, the Organizer excludes his liability under the warranty.
6. The Organizer does not provide a guarantee for auction items. 

§ 1. DEFINICJE

1. „Organizator” - NUMIS POLAND Krzysztof Klitończyk z siedzibą ulica Kazimierza Odnowiciela 1, 62-050 Mosina k. Poznania posiadającą NIP: 7651171479, który to podmiot wystawia przedmioty na aukcje za pośrednictwem Portalu Onebid.pl.
2. „Aukcja” – aukcja prowadzona za pośrednictwem Portalu Onebid.pl, posiadającym adres internetowy https://onebid.pl/.
3. „Uczestnik” – podmiot biorący udział w Aukcji Organizatora na Portalu Onebid.pl. 
4. „Zwycięzca aukcji” – Uczestnik, którego oferta była najwyższa, która została przybita oraz który wygrał daną aukcję. 
5. „Umowa” – umowa sprzedaży zawierana ze Zwycięzcą aukcji w przypadkach szczegółowo opisanych poniżej.
6. „Opłata aukcyjna” – jest to kwota stanowiącą dodatkową opłatę nie ujętą w aktualnie prezentowanej ofercie. Jest ona dodatkowo doliczana do kwoty jaką musi uiścić zwycięzca aukcji. Jej wysokość została określona poniżej. 

§ 2. ZGODY UCZESTNIKA

1. Uczestnik biorąc udział w Aukcji akceptuje i wyraża zgodę na treść przedmiotowego regulaminu.
2. Uczestnik wyraża dobrowolną zgodę na przetwarzanie przez Organizatora jego danych osobowych w celach związanych z Aukcją oraz zawarciem i finalizacją Umowy.
3. Uczestnik oświadcza również, iż zapoznał się z treścią regulaminu Portalu Onebid.pl i akceptuje go w pełni.

§ 3. AUKCJA

1. Aukcja odbywa się tylko i wyłącznie na Portalu Onebid.pl. Czas aukcji, jej szczegółowe warunki oraz jej przedmiot są każdorazowo określone na stronie przedmiotu na Portalu Onebid.pl. W przypadku braku odmiennych zastrzeżeń obowiązują poniższe zasady aukcji.
2. Uczestnikiem aukcji może być tylko osoba pełnoletnia oraz posiadająca pełną zdolność do czynności prawnych w myśl przepisów Prawa cywilnego, osoby prawne oraz jednostki organizacyjne niebędące osobami prawnymi, którym ustawa przyznaje zdolność prawną. 
3. Aukcja rozpoczyna się dopiero z momentem określonym na stronie danego przedmiotu od ceny wywoławczej.
4. Przedmiot może posiadać określoną ofertę minimalną, poniżej której zawarcie Umowy wymaga zgody właściciela.
5. Wszelkie oferty złożone przed rozpoczęciem aukcji w dowolnej formie są nieważne. 
6. Wiążące i ważne są jedynie oferty złożone w trakcie trwania licytacji za pośrednictwem Portalu Onebid.pl.
7. Oferta złożona w toku aukcji przestaje wiązać, gdy inny uczestnik aukcji złożył ofertę korzystniejszą.
8. Zakończenie aukcji następuje wraz z momentem przybicia najkorzystniejszej oferty. 
9. Jeżeli najwyższa oferta jest poniżej oferty minimalnej nie następuje zawarcie umowy sprzedaży do momentu uzyskania ewentualnej zgody właściciela przedmiotu. 
10. Jeżeli najwyższa oferta jest wyższa lub równa ofercie minimalnej wraz z momentem przybicia następuje zawarcie umowy sprzedaży. 
11. Organizator może żądać unieważnienia zawartej umowy, jeżeli strona tej umowy, inny uczestnik lub osoba działająca w porozumieniu z nimi wpłynęła na wynik aukcji w sposób sprzeczny z prawem lub dobrymi obyczajami.

§ 4. ZAPŁATA CENY

1. Cenę sprzedaży wylicytowanych przedmiotów stanowi przybita oferta powiększona o opłatę aukcyjną w wysokości 18% wylicytowanej kwoty. 
2. Wylicytowana cena podlega zapłacie w terminie 10 dni kalendarzowych od zakończenia licytacji. 
3. Brak zapłaty ceny we wskazanym terminie uprawnia Organizatora do wyznaczenia dodatkowego terminu do zapłaty, pod rygorem odstąpienia od umowy. 
4. W przypadku, jeżeli powyższy termin upłynie bezskutecznie Organizator będzie uprawniony do odstąpienia od umowy oraz może on żądać naprawienia ewentualnej szkody wynikłej ze zwłoki. 
5. Niezależnie od powyższych uprawnień Organizatorowi przysługuje prawo naliczania odsetek ustawowych za opóźnienie, jeżeli nie skorzysta on skutecznie z prawa odstąpienia od umowy.  
6. Prawo własności przedmiotu aukcji przechodzi na Zwycięzcę aukcji dopiero z momentem uiszczenia całości ceny. 
7. Cena może zostać uiszczona na następujący rachunek bankowy Organizatora w Mbank:

8. Cena może również zostać uiszczona w gotówce, w siedzibie Organizatora, jeżeli kwota całej transakcji, bez względu na liczbę wynikających z niej płatności, nie przekracza kwoty 15.000 euro, przy czym transakcje w walutach obcych przelicza się na złote według kursu średniego walut obcych ogłaszanego przez Narodowy Bank Polski z ostatniego dnia roboczego poprzedzającego dzień dokonania transakcji.

§ 5. WYDANIE PRZEDMIOTÓW

1. Wydanie przedmiotów stanowiących przedmiot aukcji następuje dopiero po zapłacie całkowitej ceny przez Zwycięzcę aukcji, czyli dopiero po przejściu prawa własności. 
2. Przedmioty mogą zostać odebrane osobiście przez Zwycięzcę aukcji w siedzibie Organizatora. 
3. Możliwe jest też przesłanie wylicytowanych przedmiotów w formie ustalonej indywidualnie pomiędzy Organizatorem a Zwycięzcą aukcji. 
4. Wszelkie koszty wydania lub przesłania przedmiotów wylicytowanych obciążają w całości Zwycięzcę aukcji. 
5. Wysyłka przedmiotów aukcji nastąpi po uzgodnieniu sposobu wysyłki, opłaceniu kosztów z tym związanych przez Zwycięzcę aukcji oraz po uiszczeniu całkowitej ceny. 
6. Wszelkie dodatkowe opłaty związane z wysyłką przedmiotów aukcji obciążają również Zwycięzcę aukcji, w szczególności ubezpieczenie przedmiotowej przesyłki.
7. Czas wysyłki przedmiotów wynosi do 7 dni roboczych od momentu zaksięgowania przelewu na koncie bankowym.
8. Koszt wysyłki na ternie Polski kurierem do wyboru ( DPD, DHL, UPS) wynosi 25 złotych. Jeśli kupujący mailowo nie wskaże firmy przewozowej, Organizator wyślę przesyłkę jednym z trzech wymienionych (DPD, DHL, UPS). Istnieje możliwość wysłania przesyłki do paczkoamtu Inpost - koszt 15 złotych. Kupujący musi mailowo wyrazić chęć skorzystania z takiej opcji.
9. Koszt wysyłki zagranicznej, do kwoty zakupów 1000 złotych Poczta Polska koszt - 25 złotych, powyżej kwoty 1000 złotych tylko kurier koszt 100 złotych.

§ 6. KLAUZULE I ZASTRZEŻENIA DODATKOWE

1. Przedmioty wpisane do Rejestru Zabytków lub o wartości powyżej 16.000 PLN mogą być wywiezione poza granicę Polski tylko po uzyskania pozwolenia na wywóz. Organizator poucza Uczestników, iż swobodne dysponowanie licytowanymi rzeczami może podlegać ograniczeniom wynikającym z Ustawy z dnia 23 lipca 2003 r. o ochronie zabytków i opiece nad zabytkami, w szczególności z art. 51 ww. Ustawy, który przewiduje m.in. konieczność uzyskania zgody na wywóz określonych tam zabytków poza granice Polski. 
2. Organizator nie bierze odpowiedzialności za powyższe ograniczenia oraz nie deklaruje pośrednictwa czy pomocy w czynnościach wynikający z ww. Ustawy a obciążających właściciela. 
3. Dane osobowe Uczestnika są zbierane jedynie w celu przeprowadzenia Aukcji oraz zawarcia i realizacji ewentualnie zawartej Umowy. 
4. Dostęp do danych osobowych Uczestnika posiada jedynie Organizator i nie są one udostępniane podmiotom zewnętrznym, za wyjątkiem niezbędnym do realizacji przedmiotu ewentualnie zawartej Umowy, w szczególności przesłania przedmiotów aukcji do Zwycięzcy aukcji. 
5. Uczestnik posiada prawo dostępu do treści swoich danych oraz ich poprawiania. 
6. Dane osobowe, jeżeli nie zostały przekazane wprost przez samego Uczestnika, pochodzą z portalu Onebid.pl.
7. Organizator nie ponosi odpowiedzialności za problemy techniczne związane z funkcjonowaniem Portalu Onebid.pl.

§ 7. POSTANOWIENIA KOŃCOWE

1. Organizator zastrzega sobie prawo zmiany przedmiotowego regulaminu, z zastrzeżeniem, iż zmiany w regulaminie wchodzą w życie w terminie 7 dni od ich ogłoszenia na Portalu Onebid.pl.
2. Jeżeli którekolwiek postanowienia regulaminu będą z jakichkolwiek przyczyn nieważne, pozostałe jego zapisy pozostają w mocy. 
3. Prawem właściwym do stosunków pomiędzy Uczestnikami a Organizatorem jest powszechnie obowiązujące prawo polskie, w szczególności przepisy Kodeksu cywilnego. 
4. Organizator poucza, iż w przypadku, gdy kupujący jest konsumentem w myśl przepisów Kodeksu cywilnego, przysługują mu uprawnienia z tytułu rękojmi za wady przy sprzedaży. 
5. Jeżeli kupującym jest przedsiębiorca w myśl przepisów Kodeksu cywilnego, Organizator wyłącza swoją odpowiedzialność z tytułu rękojmi.
6. Organizator nie udziela gwarancji na przedmioty aukcji.
